Terms of Trade

1. General
1.1 These Terms of Trade govern the supply of goods and services by Chatham Islands Shipping Limited ("CISL", "we", "our", "us") to our customers ("you", "your"). By using our services, you agree to these Terms of Trade.

1.2 We reserve the right to amend these terms at any time. Updates will be posted on our website, and continued use of our services constitutes acceptance of any changes.

2. Pricing and Payment
2.1 All prices are quoted in New Zealand Dollars (NZD) and are exclusive of GST unless stated otherwise.

2.2 Payment must be made in full prior to the dispatch of goods or completion of services unless otherwise agreed in writing.

2.3 We accept payment by direct bank transfer and other payment methods as specified on our website.

2.4 Any overdue payments may incur interest at the rate of 2% per month and collection costs where applicable.

3. Bookings and Cancellations
3.1 Cargo bookings must be made in advance through our designated booking channels.

3.2 Cancellations must be made at least 48 hours prior to the scheduled departure. Failure to cancel within this timeframe may result in forfeiture of any payments made.

3.3 CISL reserves the right to cancel or reschedule services due to operational or safety reasons. In such cases, customers will be notified, and alternative arrangements will be provided where possible.

4. Shipping and Delivery
4.1 Delivery timeframes are estimates only and may be affected by weather conditions, regulatory compliance, or other unforeseen circumstances.

4.2 Risk in the goods passes to you upon delivery or upon collection by your nominated agent.

4.3 We are not liable for any loss, damage, or delay in delivery due to circumstances beyond our control.

5. Liability and Insurance
5.1 CISL will take all reasonable care in handling goods but accepts no liability for loss or damage unless proven to be caused by our negligence.

5.2 Customers are advised to arrange adequate insurance for their goods, as CISL does not provide insurance coverage for cargo unless agreed in writing.

5.3 Any claim made regarding damaged goods must be made in writing to us within 7 days of you receiving the freight.

6. Dangerous Goods and Restricted Items
6.1 Dangerous goods must be declared at the time of booking and must comply with all applicable regulations.

6.2 We reserve the right to refuse the carriage of prohibited or restricted items.

7. Dispute Resolution
7.1 Any disputes relating to our services should be raised in writing within 7 days of the issue arising.

7.2 We will work in good faith to resolve disputes, and if unresolved, parties may seek mediation or legal action as per New Zealand law.

8. Governing Law
8.1 These Terms of Trade are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of New Zealand courts.
